Ira A. Eddymurthy, a founding partner of SSEK Legal Consultants, was a speaker at the recent "Doing Business Across Asia: Legal Convergence in an Asian Century" conference organized by the Singapore Academy of Law on January 21 and 22.
The conference was attended by policy makers, regulators, members of the judiciary, and top leaders from the business and legal communities from the Asia Pacific, the United States and the United Kingdom. Speakers explored the challenges and opportunities of the legal convergence in Asia, and discussed cross-border trade practices and regulatory mechanisms.
Ira was part of a panel on the cross-border enforcement of commercial contracts. She examined the challenges faced by Indonesia, its decision not to accept the Hague Convention on Choice of Court Agreements, and the country's ratification of the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, allowing foreign arbitration awards to be enforced in Indonesia if certain requirements are met as stipulated in Law No. 30 of 1999 regarding Arbitration and Alternative Dispute Resolution.
According to Ira, the implementation of this law is improving but challenges remain in recognizing foreign arbitral awards in Indonesia.
The two-day conference at Raffles City Convention Centre also saw the launch of the Asian Business Law Institute (ABLI). ABLI aims to initiate, conduct and facilitate research and produce authoritative texts to promote the convergence of Asian business laws in order to lift cross-border trade.
